Again and again I see quite nicely made baby or toddler toys (crackling books, book covers, disguises, etc.)

But please also remember that you have to test AND mark this?

CITATION:
According to § 2 No. 15 2nd GPSGV, manufacturer is any natural or legal person who manufactures a toy or has a toy developed or manufactured and makes this toy available on the market under their own name or brand.

 Making a toy available on the market means any supply of a toy for distribution, consumption or use on the market of the European Union in the course of a business activity, whether in return for payment or free of charge; importation into the European Economic Area is equivalent to making a toy available on the market.



Call me a spoilsport or a sourpuss. Unfortunately, many people are unaware of the legal consequences of this!

Heat cushion:

Heat pads "for abdominal pain relief" are a "Class 1 medical device - DE/CA22/119-2" and must bear the CE mark for medical devices.


Warming cushions with toy character
If the heat cushion also has a play character, e.g. through the shape of a cuddly toy, it also falls under the Toy Directive (and the associated standards) and requires the CE marking and declaration of conformity for toys.

Question:
Are sponges that are specially designed for use by children and therefore have an attractive appearance always to be classified as toys?

Answer:
If a bath sponge for children has one or more clear play values in addition to its use for cleaning (e.g. as a cuddly toy, panelling, vehicle), the product can also be classified as a play product i. S. v. § 2 Abs. 6 Nr. 5 LFGB and/or as toys i. S. v. § 2 Nr. 24a of the 2. ProdSV to be classified.

This classification can also be transferred to washcloths in animal form!
